In the years since 2005, the majority of FDA inspections have typically been conducted by state agencies acting under contract with FDA. This number and proportion has been steadily increasing, a trend which is expected to continue. According to our interview data, FDA officials began pursuing contracts with states in the 1970s as a way to meet new annual inspections requirements (performance standards) set by Congress but typically unaccompanied by new resources. Over the years, Congress informed the agency that if it did not complete stipulated number of annual inspections, its budget would be cut. Some states have been performing contract inspections for well over a decade, while others have only begun doing so in the last few years. As of 2013, FDA contracted with 43 states, with contract work totaling $11.75 million of FDA’s budget, according to FDA budget documents. States typically do not perform all FDA inspections within their borders, but rather take responsibility for some proportion of FDA’s inspections through their contracts.3
